Sorry for such a long message. In June 1999 signed a forbearance agreement. Paid $6,000. Lender promised in writing to postpone sheriff sale untill agreement was fulfilled or broken. Agreement stated $1,600 for six months starting the month after the date shown on agreement. Date was June 15. Original sale date was set for July 13, 1999. I sent $1,700 on July 28th. Advanta sent it back saying I was to have it there by the 15th. They kept the $6,000 I sent June 28th. They cancelled the agreement. I called to find out when the new sale date was going to be and what the payoff amount was. They told me the sale wouldn't be before November and the new amount was now $9,000 as opposed to $6,000 as agreed in forbearance. Loan was transferred to a new servicer Ocwen in 2000. This is now 2001 and I get a notice of being sued for eviction They state the house was sheriff saled back to the bank on July 13, 1999. How can they do this. Where are my rights. They promised to postpone that sale and i have it in writing. Please Help!
